1. Scope of Services (The Application Suite)

Non-Commercial Use: Currently, the Turf Match Selector, Soil Profile Builder, and Hardiness Zone Finder are provided for personal, non-commercial use by DIY researchers.
Data Dependency: The accuracy of the results generated by our tools is directly dependent on the accuracy of the data you input. MFY is not responsible for skewed results caused by incorrect zip codes, soil measurements, or species identification.
Future Commercial Use: While a “White Label” feature is planned, any current attempt to scrape, embed, or resell MFY tool logic without a signed commercial agreement is strictly prohibited.

2. Nature of Data: Logic vs. AI

The Scientific Baseline: Unlike many modern platforms, MFY tools do not use AI to guess or hallucinate results. Our outputs are driven by Hardcoded Logic synthesized from University-Grade horticultural data.
Static Accuracy: Results are deterministic—meaning the same input will always yield the same scientific result based on current research. Logic updates only occur when the underlying Botanical Registry or soil science standards change.

3. No Professional-Client Relationship

Diagnostic Support: While MFY empowers you to be your own Yard Doctor, the information provided—including tool results and articles—is for educational and diagnostic support only.
Technical Disclaimer: Use of these tools does not constitute a professional consulting relationship. We provide the “Information Architecture,” but the final decision to apply chemicals, fertilizers, or cultural controls lies solely with the user. We recommend verifying high-stakes decisions with your local University Extension office.

4. Intellectual Property & The Registry

Ownership: All content, including the unique logic paths of our Application Suite, the design of our Horticultural Hubs, and our proprietary data summaries, is the intellectual property of My Fine Yard.
User Inputs: By using our tools, you grant MFY the right to use anonymized data points (e.g., zip codes and soil types) to improve our global Phenological maps and research accuracy. We do not claim ownership of your specific personal identifiers.

5. Limitation of Liability

The “Biological Variable”: Horticulture involves living organisms and unpredictable environmental factors. MFY provides data “as-is.”
Damage Waiver: In no event shall My Fine Yard be liable for any damage to property (including but not limited to turf death, plant loss, or soil degradation) resulting from the use or misuse of our tools, articles, or recommendations. You apply our research at your own risk.

6. Acceptable Use

Users are prohibited from:

• Using automated scripts to “stress test” or extract data from the Application Suite.
• Circumventing Cloudflare Turnstile or other security protocols.
• Providing intentionally false data that could corrupt our regional research trends.

7. Governing Law

Governing Law: These terms and your use of the MFY Registry are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
Dispute Resolution: All disputes shall be resolved through final and binding Arbitration rather than in court. This ensures a streamlined, technical resolution for any issues regarding our Application Suite or data accuracy.

8. Amendments

We reserve the right to “Prune and Graft” these terms as the project evolves. Continued use of the site after changes are posted constitutes acceptance of the new terms.
